1. Acceptance of Terms

By accessing or using Minti ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to update these Terms at any time, and continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Minti is a collectibles management and marketplace platform that provides:

• AI-powered identification, grading, and valuation of physical collectibles
• Collection management and portfolio tracking tools
• A peer-to-peer marketplace for buying and selling collectibles
• Social features including public profiles, posts, and messaging
• Data export capabilities (PDF and CSV)

3. Account Registration

To use Minti, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access
• Be responsible for all activities under your account

You must be at least 13 years of age to create an account. If you are under 18, you represent that you have parental or guardian consent.

4. Subscription Tiers

Minti offers multiple subscription tiers with different features and limits:

• Free: Basic collection management with limited features
• Collector: Enhanced features, expanded limits, and marketplace access
• Pro: Full access to all features including advanced analytics and unlimited scans

Subscription payments are processed by Stripe. Subscriptions renew automatically unless cancelled. You may cancel at any time through your account settings; access continues until the end of the current billing period.

5. Marketplace

General Rules

• All listings must accurately represent the item being sold
• Sellers must have legal ownership of items they list
• Prohibited items include counterfeits, stolen goods, illegal items, and items that violate third-party rights

Transactions

• All marketplace payments are processed through Stripe Connect
• Minti facilitates transactions between buyers and sellers but is not a party to the sale
• Sellers are responsible for shipping items as described and within the stated timeframe
• Buyers should inspect items upon receipt and report any issues promptly

Auctions

• Bids are binding commitments to purchase at the bid price
• Auctions include anti-snipe protection that may extend the end time
• Winning bidders must complete payment within the designated timeframe

6. AI Features and Valuations

Minti uses artificial intelligence to provide collectible identification, grading, and valuation estimates. You acknowledge that:

• AI-generated identifications and grades are estimates only and may not be perfectly accurate
• Valuations are based on available market data and are not guarantees of actual market value
• AI grading does not replace professional third-party grading services (PSA, BGS, CGC, etc.)
• You should not rely solely on AI valuations for significant financial decisions

7. User Content

You retain ownership of content you upload to Minti (photos, descriptions, posts). By uploading content, you grant Minti a non-exclusive, worldwide license to use, display, and process your content as needed to provide the Service. You agree not to upload content that:

• Infringes on intellectual property rights
• Is illegal, harmful, threatening, or harassing
• Contains malware or spam
• Misrepresents your identity or affiliation

8. Prohibited Conduct

When using Minti, you agree not to:

• Violate any applicable laws or regulations
• Manipulate marketplace prices, bids, or reviews
• Create multiple accounts to circumvent limits or bans
• Scrape, crawl, or harvest data from the Service
• Interfere with the Service's operation or security
• Harass, bully, or threaten other users

Violations may result in account suspension or permanent termination at our discretion.

9. Intellectual Property

The Minti name, logo, app design, and associated branding are owned by Minti. You may not use our trademarks without prior written consent. The Service, including its code, design, and features, is protected by intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law:

• Minti is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the Service in the preceding 12 months
• We are not responsible for losses resulting from marketplace transactions, AI valuation inaccuracies, or unauthorized account access

11. Account Termination

You may delete your account at any time through your settings or by contacting support@minti-app.com. We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.
